1. Acceptance of Terms
By accessing or using any services provided by Scriptful ("Company," "we," "us," or "our"), including our website, platform, SMS messaging services, and ringless voicemail services (collectively, "Services"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services
2. Description of Services
Scriptful provides a software platform that enables businesses to communicate with their customers via SMS/MMS text messaging and ringless voicemail (RVM) delivery. Our Services are intended for business or professional use only.
3. SMS Messaging Terms
3.1 Program Description
By opting into Scriptful's SMS program, you consent to receive text messages from Scriptful and/or its clients, which may include promotional offers, appointment reminders, transactional alerts, follow-ups, and other business-related communications.
3.2 Consent & Opt-In
By providing your mobile phone number and opting in — whether via a web form, keyword, verbal agreement, or written consent — you expressly consent to receive SMS and/or MMS messages from us. Consent must be clearly and affirmatively given. Written consent includes digital opt-ins, checkboxes on web forms, or signed agreements. Consent is not a condition of purchase.
3.3 Opt-Out / Cancellation
You can cancel the SMS service at any time. Just text "STOP" to the shortcode or number from which you received messages. After you send the SMS message "STOP," we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3.4 Help / Support
If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly by contacting us at: info@scriptful.com.
3.5 Message Frequency
Message frequency may vary based on your account activity and the services you are subscribed to. You will receive messages based on your opt-in preferences and the specific program you enrolled in.
3.6 Message & Data Rates
Carriers are not liable for delayed or undelivered messages. Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
3.7 Quiet Hours
SMS messages scheduled during quiet hours will be subject to compliance checks. The U.S. Federal Communications Commission defines these quiet hours under the Telephone Consumer Protection Act (TCPA) as 9:00 PM to 8:00 AM in the recipient's local time zone. We do not send non-essential or marketing messages during these hours.
3.8 Twilio Messaging Policy Compliance
Our SMS and MMS services are delivered via Twilio. Twilio's Messaging Policy applies to SMS, MMS, and other messaging channels. This policy provides the restrictions and requirements that you, your organization, and your customers must abide by to use Twilio Messaging Services. You agree that you will not use our messaging services to transmit content or support a use case that is prohibited by law, regulation, or carrier requirement.
4. Ringless Voicemail (RVM) Terms
4.1 What Is Ringless Voicemail?
Ringless voicemail (RVM) is a technology that delivers a pre-recorded audio message directly to a recipient's voicemail inbox without causing the phone to ring. The FCC has ruled that messages delivered using ringless voicemail technology to wireless numbers are classified as a "call" under the TCPA.
4.2 Consent Requirement
The TCPA prohibits using an automatic telephone dialing system (ATDS) or prerecorded message to contact cell phones unless the recipient has provided and not revoked "consent" to receive the call or text. For marketing messages — those encouraging the purchase of a product or service — you must obtain prior express written consent. This means the customer must clearly agree in writing to receive messages. Written consent includes digital opt-ins, checkboxes on web forms, or signed agreements.
4.3 Opt-Out / Do Not Call
Recipients may opt out of ringless voicemail messages at any time by:
• Replying "STOP" to any follow-up SMS associated with the campaign
• Contacting us directly at info@scriptful.com or 888-707-1782
• Placing themselves on our internal Do Not Contact list
We will honor all opt-out requests promptly and remove the individual from all future RVM campaigns. We scrub against the National Do Not Call Registry at least every 31 days, check state-specific DNC registries where applicable, and maintain internal Do Not Call lists for anyone who opts out.
4.4 Calling Hours
Time-of-day restrictions apply to ringless voicemail. The TCPA limits calling to between 8:00 AM and 9:00 PM in the called party's local time zone. Some states impose even tighter calling windows. We apply the most restrictive applicable rule for each consumer's location.
4.5 Penalties for Non-Compliance
Users who send RVM campaigns through Scriptful without proper consent may be held personally liable. Violations of the TCPA can cost your business between $500 and $1,500 per message sent.
5. Prohibited Uses
You agree not to use Scriptful's Services to:
• Send messages without prior express written consent from recipients
• Contact numbers on the National DNC Registry without proper exemption
• Send spam, misleading, or deceptive messages
• Violate any federal, state, or local laws including the TCPA, CAN-SPAM Act, or FTC's Telemarketing Sales Rule
• Send messages outside of permitted hours
• Impersonate any person or entity
• Engage in any activity prohibited by Twilio's Acceptable Use Policy
6. Compliance Responsibility
You, the customer, are ultimately responsible for TCPA compliance when using any messaging platform. Scriptful provides tools designed to support compliance but cannot guarantee compliance outcomes because users control who receives messages, the content of messages, and the consent practices employed. You must maintain all compliance records for at least five years from the date of last contact with each consumer.
7. Modifications to Terms
We reserve the right to update these Terms at any time. Changes will be effective upon posting to our website. Continued use of our Services after changes constitutes your acceptance of the new Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
