1. Acceptance of Terms
By accessing or using any services provided by Scriptful ("Company," "we," "us," or "our"), including our website, platform, SMS messaging services, and ringless voicemail services (collectively, the "Services"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
By using the Services, you represent and warrant that you are at least eighteen (18) years of age and have the legal authority to enter into these Terms.
2. Eligibility
Scriptful's Services are intended solely for individuals who are eighteen (18) years of age or older. By creating an account, accessing, or using the Services, you affirm that you are at least eighteen (18) years old.
If we discover that a user is under the age of eighteen (18), we reserve the right to suspend or terminate access immediately.
3. Description of Services
Scriptful provides a software platform that enables businesses to communicate with their customers via SMS/MMS text messaging and ringless voicemail delivery. Our Services are intended for business and professional use only.
4. SMS Messaging Terms
4.1 Program Description
By opting into Scriptful's SMS program, you consent to receive text messages from Scriptful and/or its clients. Messages may include promotional offers, appointment reminders, transactional alerts, account notifications, customer service communications, follow-ups, and other business-related communications.
4.2 Consent & Opt-In
By providing your mobile phone number and opting in through a website form, checkbox, keyword, written agreement, electronic signature, or other authorized method, you expressly consent to receive SMS and MMS messages from Scriptful and/or its clients.
Consent must be clear, affirmative, and documented. Consent is not a condition of purchase.
4.3 Message Frequency
Message frequency varies depending on your account activity, communication preferences, and the programs in which you participate.
4.4 Message & Data Rates
Message and data rates may apply. Charges are determined by your wireless carrier and mobile plan.
4.5 Opt-Out / Cancellation
You may opt out of SMS communications at any time by replying STOP to any message received from us.
After you send STOP, you will receive a confirmation message indicating that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages unless you opt in again.

4.7 Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
4.8 Quiet Hours
Scriptful observes applicable federal and state communication regulations. Non-essential marketing messages will not be sent between 9:00 PM and 8:00 AM in the recipient's local time zone unless otherwise permitted by law.
4.9 Twilio Messaging Policy Compliance
Scriptful utilizes Twilio and other messaging providers to deliver communications. Users agree to comply with all applicable laws, carrier requirements, CTIA Messaging Principles, and Twilio Messaging Policies.
Users may not use Scriptful to transmit messages that violate carrier requirements, industry standards, or applicable laws.
4.10 Privacy Policy
Your use of Scriptful's messaging services is also governed by our Privacy Policy. By opting into our messaging programs, you acknowledge and agree to the terms of our Privacy Policy.
5. Ringless Voicemail (RVM) Terms
5.1 What Is Ringless Voicemail?
Ringless voicemail (RVM) is a technology that delivers a prerecorded audio message directly to a recipient's voicemail inbox without causing the recipient's phone to ring.
The FCC has determined that ringless voicemail messages delivered to wireless numbers may be considered calls under the Telephone Consumer Protection Act (TCPA).
5.2 Consent Requirement
Users must obtain all legally required consent before sending ringless voicemail campaigns.
For marketing-related communications, prior express written consent is required. Written consent may include electronic signatures, website forms, digital checkboxes, signed agreements, or other legally recognized methods.
5.3 Opt-Out / Do Not Call
Recipients may opt out of future communications by:
• Replying STOP to associated SMS messages
• Contacting Scriptful directly
• Requesting placement on our internal Do Not Contact list
We will honor opt-out requests promptly and maintain suppression records as required by law.
5.4 Calling Hours
Ringless voicemail campaigns must comply with all applicable federal and state time restrictions.
Unless otherwise required by law, messages may only be delivered between 8:00 AM and 9:00 PM in the recipient's local time zone.
5.5 Penalties for Non-Compliance
Users who send communications without the required consent may be personally liable for violations of the TCPA and other applicable laws. Penalties may range from $500 to $1,500 per unlawful communication.
6. Prohibited Uses
You agree not to use Scriptful's Services to:
• Send messages without legally required consent
• Contact individuals who have opted out or are on applicable Do Not Call lists
• Send spam, unsolicited messages, or deceptive communications
• Violate the TCPA, CAN-SPAM Act, FTC Telemarketing Sales Rule, or any other applicable law
• Send messages outside permitted communication hours
• Impersonate any person, company, or organization
• Engage in phishing, fraud, or identity theft
• Promote illegal products, services, or activities
• Send sexually explicit, abusive, hateful, or harassing content
• Promote unlawful gambling, controlled substances, or other prohibited products
• Violate Twilio's Acceptable Use Policy or Messaging Policy
Scriptful reserves the right to suspend or terminate any account that engages in prohibited activity.
7. Compliance Responsibility
Users are solely responsible for ensuring that their communications comply with all applicable laws and regulations.
Scriptful provides tools intended to assist with compliance but does not guarantee legal compliance because users control recipient data, consent collection, and message content.
7.1 Record Retention
Users must maintain records of consent, including the date, time, method, source, and any supporting documentation demonstrating consent.
Such records must be retained for a minimum of five (5) years from the date of the last communication.
7.2 Customer Certification
By using Scriptful's Services, you certify that all recipients have provided the level of consent required under applicable laws, regulations, carrier requirements, and industry guidelines.
8. Limitation of Liability
To the fullest extent permitted by law, Scriptful shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Services.
Scriptful's total liability under these Terms shall not exceed the amount paid by the user to Scriptful during the twelve (12) months preceding the claim.
9. Modifications to Terms
We reserve the right to update or modify these Terms at any time.
Changes become effective upon posting to our website. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
